What Is the 26,000 lb DGVW Rule?
Registration is required for any commercial motor vehicle with a declared gross vehicle weight (DGVW) over 26,000 pounds that travels on public highways in New Mexico. This includes interstate and intrastate carriers and out-of-state operators.
It does not matter whether the carrier is based in another state — once a qualifying commercial vehicle enters New Mexico and operates on its highways, it must comply with Weight Distance Tax registration requirements.

What Are the Exemptions?
Generally, exemptions apply to vehicles that do not meet the weight threshold or are not operating as taxable commercial carriers.
- Vehicles with a declared gross vehicle weight of 26,000 pounds or less
- Certain vehicles used primarily for agricultural purposes
- Vehicles owned and operated by religious organizations or qualifying nonprofits
- Federal, state, or local government-owned vehicles
- Qualified school buses
- Some vehicles within a limited area near the Mexico–New Mexico border (generally within 10 miles)
- Vehicles not traveling on public highways within New Mexico
